Viši sud u Novom Pazaru je usvojio tužbu 11 aktivistkinja i Udruženja ,,Impuls’’ iz Tutina i utvrdio diskriminaciju koju je nad njima učinio restoran ’’Ras’’ na Pazarištu tj. preduzeće ,,Code Trade JNJ’’ i Šemsović Jasmin iz Novog Pazara. Ova odluka suda je značajna za ostvarivanje ljudskih prava i zaštitu onih koja ta prava brane, a koji se sve češće nalaze na udaru različitih desno orijentisanih pojedinaca i grupa.
Naime, vlasnik restorana je tužiljama, učesnicama Festivala ženskog prijateljstva u avgustu 2019. godine otkazao unapred rezervisanu večeru zbog diskriminatorskog stava da pripadaju gej populaciji i time prekršio Zakon o zabrani diskriminacije u članovima 12, 17, 20 i 21 – navodi se u presudi.
Iako je na ovu presudu moguće podneti žalbu, odluka Višeg suda u Novom Pazaru je veliki korak u primeni zakona iz oblasti ljudskih prava. Sud je utvrdio da su restoran ’’Ras’’ na Pazarištu tj. preduzeće ,,Code Trade JNJ’’ kao i Šemsović Jasmin, zajedno, izvršili čak četiri oblika teške diskriminacije jer su tužilje uznemiravali i prema njima ponižavajuće postupali, diskriminisali su ih u pružanju javnih usluga i to na osnovu pola i na osnovu pretpostavljene seksualne orijentacije.
Šta se u Tutinu tog 3. avgusta dogodilo?
U okviru IV Festivala žensog prijateljstva,,Pobuna je ženska’’, koju godinama unazad u Tutinu organizuje Udruženje ,,Impuls’’, Tutin, učesnice nisu mogle da dođu u restoran ,,Ras’’na Pazarištu, na unapred rezervisanu i dogovorenu večeru, jer je vlasnik restorana odlučio da ih ne primi u restoran, zbog pretpostavke da je reč o LGBT osobama, a ,,takvim osobama je zabranjen pristup’’. Otkazivanje gostoprimstva pratile su laži, uvrede, omalovažavanje, vređanje i pozivanje na nasilje nad aktivistkinjama. Zbog toga su se one odmah obratile svim nadležnim državnim institucijama, kao i organizacijama za zaštitu ljudskih prava.
Udruženje ,,Impuls’’ podnelo je najpre pritužbu Povereniku za zaštitu ravnopravnosti. U postupku po pritužbi, 4. februara 2020. godine doneto je mišljenje kojim je utvrđeno da je prekršen Zakon o zabrani diskriminacije, a počiniocu je naloženo da predsednici UG ,,Impuls’’ uputi pisano izvinjenje i o tome obavesti Poverenika. To se do danas nije dogodilo..
U sudskom postupku koji je jedanaest učesnica pokrenulo pred novopazarskim Višim sudom utvrđeno je da su diskriminisane i da je prema njima postupano nezakonito, ali i da pravosudni organi imaju kapaciteta da primene jedan od ,,mladih’’ zakona republike Srbije. Ovakva odluka mogla bi da označi prekretnicu u tumačenju i tretiranju ljudskih prava u Srbiji, posebno u trenutku napetih i narastajućih društvenih podela i polarizacija.

The court confirmed the discrimination of activists and the association “Impulse” in the restaurant “Ras” in Pazarište

The High Court in Novi Pazar adopted the lawsuit of 11 activists and the Association “Impulse” from Tutin and determined the discrimination committed against them by the restaurant “Ras” in Pazarište, i.e., the company “Code Trade JNJ” and Semsovic Jasmin from Novi Pazar. This court decision is important for the realization of human rights and the protection of those who defend those rights, who are increasingly under attack by various right-wing individuals and groups.
Namely, the owner of the restaurant canceled the pre-booked dinner for the plaintiffs, participants of the Women’s Friendship Festival in August 2019, due to the discriminatory attitude that they belong to the gay population and thus violated the Law on Prohibition of Discrimination in Articles 12, 17, 20 and 21.
Although it is possible to appeal this verdict, the decision of the High Court in Novi Pazar is a big step in the application of human rights laws. The court determined that the restaurant “Ras” in Pazarište, i.e., the company “Code Trade JNJ” as well as Šemsović Jasmin, together, committed as many as four different acts of severe discrimination because they harassed and humiliated the plaintiffs, discriminated against them in the provision of public services on the basis of gender and presumed sexual orientation.
What happened in Tutin on that August 3rd?
As part of the IV Festival of Women’s Friendship “It is a Women’s Rebellion”, organized by the Association “Impuls” in Tutin, the participants could not come to the restaurant “Ras” in Pazarište, for a pre-booked and arranged dinner, because the owner of the restaurant decided not to admit them to the restaurant, due to the assumption that they are LGBT people, and “such people are forbidden access”. The cancellation of hospitality was accompanied by lies, insults, belittling, name-calling and calls for violence against activists. Therefore, they immediately addressed all competent state institutions, as well as human rights organizations.
The association “Impuls” first submitted a complaint to the Commissioner for the Protection of Equality. In the complaint procedure, on February 4, 2020, an opinion was issued which established that the Law on Prohibition of Discrimination had been violated, and the perpetrator was ordered to send a written apology to the president of UG “Impuls” and inform the Commissioner. That has not happened until today.
In the court procedure initiated by eleven participants before the Novi Pazar High Court, it was determined that they were discriminated against and treated illegally, but also that judicial bodies have the capacity to apply one of the “young” laws of the Republic of Serbia. Such a decision could mark a turning point in the interpretation and treatment of human rights in Serbia, especially at a time of tense and growing social divisions and polarizations.
